1. Agreement to Terms

By accessing, browsing, or purchasing from the VantaRide Co website located at vantaride.co ("Site"), you ("buyer," "customer," "you," or "your") agree to be bound by these Terms of Service ("Terms"), our Return & Refund Policy, our Shipping Policy, and any other policies referenced herein.

If you do not agree to these Terms, you must not access or use the Site or purchase any products from VantaRide Co ("VantaRide," "we," "us," or "our").

We reserve the right to update or modify these Terms at any time without prior notice. Your continued use of the Site following any changes constitutes your acceptance of the revised Terms. It is your responsibility to review these Terms periodically.

2. Eligibility

By using this Site and placing an order, you represent and warrant that:

  • You are at least 18 years of age.
  • You have the legal capacity to enter into a binding agreement.
  • You are not prohibited by law from purchasing the products offered on this Site.
  • All information you provide during account creation or checkout is accurate, complete, and current.

VantaRide reserves the right to refuse service, cancel orders, or terminate access to the Site at our sole discretion for any reason, including suspected fraudulent activity or violation of these Terms.

3. Products & Descriptions

VantaRide makes reasonable efforts to display and describe products accurately on the Site. However, we do not warrant that product descriptions, images, pricing, or other content on the Site is accurate, complete, reliable, current, or error-free.

Colors and appearance of products may vary slightly due to display settings on your device. Product images are for illustrative purposes and the actual product may differ slightly in appearance.

If a product you purchase does not substantially match its description, your sole remedy is outlined in our Return & Refund Policy.

4. Product Use Disclaimer & Assumption of Risk

ALL VANTARIDE PRODUCTS ARE SOLD STRICTLY AS AUTOMOTIVE AND MOTORCYCLE ACCESSORIES FOR OFF-ROAD, PRIVATE PROPERTY, SHOW, DISPLAY, AND TRACK USE ONLY. VANTARIDE DOES NOT MANUFACTURE, DESIGN, MARKET, PROMOTE, OR SELL ITS PRODUCTS FOR USE ON PUBLIC ROADS, HIGHWAYS, OR ANY PUBLICLY ACCESSIBLE ROADWAY IN ANY JURISDICTION.

By purchasing any product from VantaRide, you acknowledge, agree, and represent that:

  • You are solely responsible for determining the legality of owning, possessing, installing, and using the product in your jurisdiction, including but not limited to compliance with all applicable federal, state, county, municipal, and local laws, regulations, and ordinances.
  • You will not use VantaRide products on public roads or in any manner that violates applicable law.
  • VantaRide makes no representations or warranties, express or implied, regarding the legality of product use in any jurisdiction.
  • You assume all risk and liability associated with the purchase, possession, installation, and use of VantaRide products.
  • You will not hold VantaRide, its owners, employees, agents, or affiliates liable for any legal consequences, fines, penalties, citations, arrests, vehicle impoundment, or any other adverse outcome resulting from your use of our products.
  • You have read and understood this disclaimer in its entirety before completing your purchase.

THIS DISCLAIMER IS A MATERIAL TERM OF YOUR PURCHASE. IF YOU DO NOT AGREE TO THESE TERMS, DO NOT PURCHASE OR USE VANTARIDE PRODUCTS.

5. Pricing & Payment

All prices displayed on the Site are in United States Dollars (USD) unless otherwise stated. Prices are subject to change at any time without prior notice. The price in effect at the time of your order will apply to that transaction.

Shipping costs, taxes, and any applicable fees are calculated and displayed at checkout before payment is submitted.

VantaRide reserves the right to:

  • Correct any pricing errors on the Site, even after an order has been placed.
  • Cancel orders placed at an incorrect price. If your order is cancelled due to a pricing error, you will receive a full refund.
  • Limit order quantities at our sole discretion.

Payment must be made in full at the time of purchase. We accept payment methods as displayed at checkout. By submitting payment, you represent that you are authorized to use the payment method provided.

6. Preorders

VantaRide may offer products on a preorder basis prior to availability. By placing a preorder, you agree to the following:

  • Full payment is collected at the time the preorder is placed.
  • Estimated shipping dates are approximate, not guaranteed, and subject to change due to manufacturing, supply chain, or logistics factors.
  • VantaRide will make reasonable efforts to fulfill preorders within the estimated timeframe and will communicate any significant delays via email.
  • Preorder cancellation requests submitted before the item has shipped will be reviewed on a case-by-case basis at the sole discretion of VantaRide.
  • If VantaRide is unable to fulfill a preorder within a reasonable timeframe, we will offer the buyer a full refund.
  • Preorder purchases are subject to our Return & Refund Policy and Shipping Policy.

7. Intellectual Property

All content on the Site, including but not limited to the VantaRide name, logo, monogram, brand marks, product names, text, images, graphics, videos, page layouts, designs, and software, is the property of VantaRide Co and is protected by United States and international copyright, trademark, and intellectual property laws.

You may not:

  • Copy, reproduce, distribute, modify, create derivative works of, publicly display, or otherwise exploit any content from the Site without prior written consent from VantaRide.
  • Use the VantaRide name, logo, or any brand marks for any commercial purpose without prior written consent.
  • Use any data mining, scraping, or similar automated methods to collect content from the Site.

8. User Conduct

By using the Site, you agree not to:

  • Use the Site for any unlawful purpose or in violation of any applicable law.
  • Attempt to gain unauthorized access to any portion of the Site, its systems, or networks.

VantaRide reserves the right to terminate your access to the Site for violation of these terms without prior notice.

We are not responsible for the content, privacy policies, practices, or availability of any third-party sites or services. Your use of third-party services is at your own risk and subject to the terms and conditions of those third parties.

VantaRide uses third-party service providers for payment processing, shipping, and other operational functions. Your use of those services is subject to their respective terms and privacy policies.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, VANTARIDE CO, ITS OWNERS, OFFICERS, EMPLOYEES, AGENTS, AFFILIATES, AND SUPPLIERS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES ARISING OUT OF OR IN CONNECTION WITH:

  • YOUR PURCHASE, USE, INSTALLATION, OR INABILITY TO USE ANY VANTARIDE PRODUCT.
  • YOUR ACCESS TO OR USE OF THE SITE.
  • ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SITE.
  • ANY UNAUTHORIZED ACCESS TO OR ALTERATION OF YOUR TRANSMISSIONS OR DATA.
  • ANY LEGAL FINES, PENALTIES, CITATIONS, ARRESTS, OR OTHER LEGAL CONSEQUENCES ARISING FROM THE USE OF VANTARIDE PRODUCTS.
  • ANY DAMAGE TO VEHICLES, MOTORCYCLES, EQUIPMENT, OR PROPERTY ARISING FROM PRODUCT INSTALLATION OR USE.
  • ANY PERSONAL INJURY OR DEATH ARISING FROM PRODUCT INSTALLATION OR USE.

IN NO EVENT SHALL VANTARIDE'S TOTAL LIABILITY TO YOU EXCEED THE AMOUNT YOU PAID FOR THE SPECIFIC PRODUCT GIVING RISE TO THE CLAIM.

THIS LIMITATION APPLIES REGARDLESS OF THE LEGAL THEORY ON WHICH THE CLAIM IS BASED, INCLUDING BUT NOT LIMITED TO CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY, WARRANTY, OR OTHERWISE.

11. Indemnification

You agree to indemnify, defend, and hold harmless VantaRide Co, its owners, officers, employees, agents, and affiliates from and against any and all claims, liabilities, damages, losses, costs, expenses, and fees (including reasonable attorneys' fees) arising out of or in connection with:

  • Your purchase, possession, installation, or use of any VantaRide product.
  • Your violation of these Terms or any applicable law.
  • Your use of the product on public roads or in any manner not consistent with the intended off-road, private property, show, display, or track use.
  • Any claim by a third party related to your use of VantaRide products.
  • Any misrepresentation made by you.

This indemnification obligation survives the termination of these Terms and your use of the Site.

12. Disclaimer of Warranties

ALL PRODUCTS AND THE SITE ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, VANTARIDE DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO:

  • IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
  • WARRANTIES ARISING FROM COURSE OF DEALING, USAGE, OR TRADE PRACTICE.
  • ANY WARRANTY THAT THE SITE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.
  • ANY WARRANTY REGARDING THE ACCURACY OR RELIABILITY OF INFORMATION OBTAINED THROUGH THE SITE.

VANTARIDE DOES NOT WARRANT THAT ITS PRODUCTS ARE LEGAL TO USE IN YOUR JURISDICTION. IT IS YOUR SOLE RESPONSIBILITY TO DETERMINE LEGALITY BEFORE PURCHASE AND USE.

13. Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of New Jersey, without regard to its conflict of law provisions.

Any dispute, claim, or controversy arising out of or relating to these Terms, your use of the Site, or your purchase or use of VantaRide products shall first be attempted to be resolved through informal negotiation by contacting us at vantaride@gmail.com.

If a dispute cannot be resolved through informal negotiation within 30 calendar days, either party may pursue resolution through binding arbitration administered in accordance with the rules of the American Arbitration Association. Arbitration shall take place in New Jersey.

YOU AGREE THAT ANY DISPUTE RESOLUTION PROCEEDINGS WILL BE CONDUCTED ONLY ON AN INDIVIDUAL BASIS AND NOT IN A CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION. YOU WAIVE ANY RIGHT TO PARTICIPATE IN A CLASS ACTION LAWSUIT OR CLASS-WIDE ARBITRATION.

14. Severability

If any provision of these Terms is found to be unlawful, void, or unenforceable by a court of competent jurisdiction, that provision shall be deemed severable and shall not affect the validity and enforceability of the remaining provisions.

15. Entire Agreement

These Terms, together with our Return & Refund Policy, Shipping Policy, and any other policies referenced herein, constitute the entire agreement between you and VantaRide regarding your use of the Site and purchase of products, and supersede all prior or contemporaneous agreements, communications, or proposals, whether oral or written.
